1. Survivorship
    1. Every person other than my Spouse who would otherwise benefit under this Will but who fails to survive me for 28 days shall be treated for all purposes as having died before me.
  1. Personal Possessions
    1. I give my Trustees all my Personal Possessions, except for any that I specifically give to other people in this will, with a request to distribute them according to the latest wishes I have expressed in any note left with my papers at my death and to treat any item about which I express no wishes as if it were part of the Trust Fund. This clause does not give anyone except my Trustees a legal right to any of my Personal Possessions.
    2. If, by the first anniversary of my death, my Trustees have not agreed on dividing the items, my Trustees must divide them among the Beneficiaries of the Trust Fund, as near to equally by value as is practicable. My Trustees may also sell any item and divide the sale proceeds to achieve equality of value. I request my Trustees to take the Beneficiaries' wishes into account, but my Trustees are free to value, and divide, and sell the items as they think best and the Beneficiaries must accept my Trustees' decisions.
    3. My Trustees must pay from my Estate the costs of insuring the items included in the gifts in this clause until the ultimate recipients are in possession of them.
  1. Inheritance Tax
    1. My Trustees must pay all inheritance tax payable as a result of my death on any specific gifts in this will from my Estate, except when this will expressly states that a gift is subject to inheritance tax.
    2. Any specific gift or pecuniary or general legacy made by this Will or any codicil to this Will which is expressed to be ‘free of tax’ shall be free from the payment of any inheritance tax or foreign tax or duty payable on or by reason of my death and such inheritance tax or foreign tax or duty shall be paid out of my residuary estate.
  1. Distribution of belongings
    1. In the event of any query arising after my death as to the identity of any item referred to in this Will or as to whom such item should be allocated or as to its value the decision of my Executors shall be final.
    2. In the event that my Executors cannot agree on the value of one or more of my personal belongings, or to the extent that it is required for tax purposes, my Executors shall seek an independent professional valuation of the item or items so that the professional value of the item or items is used in the calculation of the value of my estate.
    3. If one or more of my personal belongings are distributed amongst one or more of my Beneficiaries, the value of each item shall be taken into consideration by my Executors when working out the fair distribution of my Residuary Estate.
  1. Gifts to children shall not lapse
    1. If any child of mine dies before me, my Trustees must hold the share of the Trust Fund that they would otherwise have held for my child on trust for my child's own children living at my death in equal shares absolutely. If my child had any child who also dies before me (my grandchild), my Trustees must hold the share of the Trust Fund that they would otherwise have held for my grandchild on trust for my grandchild's own children living at my death in equal shares absolutely, and so on for each subsequent generation.
  1. Executors’ power to charge
    1. An Executor, whether acting as a person engaged in a profession or business or in a personal capacity, shall be entitled to all normal professional or other fees for business done, services rendered or time spent by him personally, or by his firm or company, in the administration of my Estate, including acts which an executor not engaged in any profession or business could have done personally.
    2. Any Executor who is entitled to be remunerated in accordance with my Will shall be paid such remuneration as an administration expense in priority to all legatees under my Will or any codicil.
  1. Protection of Executors
    1. No Executor shall be liable for any loss to my estate except as a result of the fraud or dishonesty of such Executor;
    2. No Executor shall be liable for any loss to my estate to any person beneficially interested in my estate of whose existence my Executors had no actual notice at the time of any distribution.
  1. Timing of exercise of powers
    1. My Trustees may exercise every power given to them by law or this Will or by any codicil to it before and after the administration of my estate is complete and before a grant of representation has been obtained.
  1. Administrative powers and provisions
    1. The standard provisions of the Society of Trust and Estate Practitioners (2nd Edition) shall apply except that in the case of any inconsistency between the provisions and this Will, then the clauses of this Will shall prevail.
